This petitioner, a federal prisoner residing at the Federal Correctional Institution in Memphis, Tennessee, requests to be released pending his appeal from a district court judgment dismissing his petition for a writ of habeas corpus filed under 28 U.S.C.§ 2241. Seeking relief under the Interstate Agreement on Detainers Act (IAD), the petitioner alleged that the Puerto Rican authorities waived their right to take custody over himself by failing "until recently" to lodge a detainer on him in Memphis, Tennessee. Puerto Rico seeks custody over the petitioner so he can finish serving his sentence of ten years for his conviction obtained under 18 U.S.C. § 2114. The petitioner had been released on parole from that sentence when he was arrested and eventually convicted and ordered to serve a sentence which he was serving when he filed his petition. Petitioner states that Puerto Rico waited too long to file its detainer on August 30, 1982 for having violated the terms of his parole on an unspecified date. The district court summarily dismissed the petition due to petitioners failure to exhaust his available state court remedies.
